Terms of Service

By creating an account or using Evenfall (the “Service”), you agree to these terms. If you don't agree, don't use the Service.

Evenfall is a client for AI chat. You type a message; we send it to an underlying AI model and stream the response back. Responses come from the model, not from us.

You need an account to use the Service. Keep your credentials private. You're responsible for activity under your account. Notify us if you believe your account is compromised.

You must be at least 13 years old (or the minimum age required by your jurisdiction) to use Evenfall.

Don't use the Service to:

• Break the law (yours, ours, or the model provider's applicable rules).
• Generate content that sexualizes minors, facilitates imminent real-world harm, or is intended to harass or defame specific individuals.
• Attempt to reverse-engineer the Service or bypass rate limits.
• Resell access or proxy the Service to other users.
• Submit content that infringes someone else's copyright or other rights.

We may suspend or terminate accounts that violate this section. We may report illegal activity to law enforcement.

You retain ownership of the prompts you send and the responses you receive. You grant us a limited license to store and display your content solely to operate the Service (e.g., showing your conversation history back to you).

AI-generated outputs are produced by the underlying model. They may be inaccurate, biased, or reflect the model's training data in ways we can't fully predict. Use them with judgment — don't rely on them for legal, medical, financial, or safety-critical decisions.

Card payments are monthly or annual subscriptions that renew automatically until cancelled; you can cancel at any time and retain access until the end of the current billing period. Crypto payments are one-time purchases that grant access for a fixed period (e.g., 30 days) and do not auto-renew; you can re-purchase when the period ends.

All sales are final. Refunds are provided where required by law or at our discretion for exceptional circumstances. Unused time has no cash value.

Prices may change. Changes apply to new purchases; existing purchases are honored at the price you paid.

Every plan includes a daily message allowance that resets each day at midnight UTC. The free plan includes 10 messages a day. Go includes 100 and Plus includes 300 — those are the published numbers, and they are literal: an ordinary message always counts as one, however long the conversation has grown.

Pro is marketed as unlimited messages*. Pro includes 500 messages a day. Every message counts as one. Your allowance is metered by what each action actually costs us to run, so a few of them draw more than one - generating an image, a web search, and uploading an image for the AI to look at. We set the allowance far above what any customer currently uses. If you ever reach it, email us and we'll sort it out.

Allowances are per account and are not transferable or poolable. We may apply additional technical limits (for example on uploads per day, saved personas, or voice minutes) that are described on the pricing and billing pages for your plan. Automated, scripted, or resold access is not permitted — see Acceptable use.

We aim for high availability but provide the Service “as is.” We may experience downtime, degraded performance, or outages with our providers that temporarily affect the Service.

You can delete your account at any time from Settings. We can suspend or terminate your account for violations of these terms. On termination, your conversation data is removed from our systems.

The Service is provided “as is” without warranty of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Service.

Our total liability in any dispute is capped at what you paid us in the twelve months preceding the claim, or USD $50 if you're on a free plan.

We may update these terms. Material changes will be announced in-app or by email. Continued use of the Service after a change means you accept the new terms.

These terms are governed by the laws of the jurisdiction where Evenfall is operated. Disputes should first be resolved informally by emailing us.
